Tripartite meeting at the Council of Europe on a draft law to reform the mechanism of compensation or restitution of property nationalised in Romania





10 April 2013 High level representatives of the Romanian government recently came to meet with the Department for the Execution of Judgments of the European Court, the Directorate General of Human Rights and Rule of law and the Registry of the European Court, for in depth consultations on the draft law prepared by the Romanian authorities aimed at addressing dysfunctions in the mechanism of compensation or restitution of property nationalised in Romania. The importance of these consultations, in order to ensure that the new legislation envisaged by the Romanian authorities offers an adequate remedy for all persons affected by these dysfunctions, was underlined during a meeting between the Secretary General of the Council of Europe, Thorbjrn Jagland and Prime Minister Victor Ponta in March, in Bucharest.

Since 2004 , when the European Court identified initial dysfunctions in the mechanism in force, the Committee of Ministers of the Council of Europe has closely followed the measures taken by the Romanian authorities aimed at resolving this complex problem, in the framework of its supervision of the execution of judgments of the Court.

Faced with the difficulties encountered by Romania in finding adequate solutions and with the massive influx of repetitive applications before the European Court, on 12 October 2010, the European Court gave a pilot judgment Maria Atanasiu and others setting a deadline for the Romanian authorities to adopt measures capable of offering adequate redress to all persons concerned by the reparation laws. This deadline, twice extended by the European Court, expires on 12 May 2013.

At the close of the tripartite meeting, the representatives of the Romanian government announced their determination to take into account the comments and suggestions made during the course of the discussions, when finalising the draft law.
