“Protection of the Rights of Entrepreneurs in the Russian Federation from Corrupt Practices – PRECOP RF"

 


The Russian authorities have expressed concern that corruption and bureaucratic pressure on business is one of the main causes which hinders national economic growth and development in the country. It has also been recognized that raiding practices are carried out with the participation of bureaucratic structures or individual officials interested in gaining control of a business. Through the joint project on the “Protection of the Rights of Entrepreneurs in the Russian Federation from Corrupt Practices” - PRECOP RF - the European Union (EU) and the Council of Europe (CoE) in cooperation with the Business Ombudsman’s Office in the Russian Federation and other stakeholder institutions aims to facilitate and contribute to the implementation of mechanisms to prevent corrupt practices affecting the business sector in the Russian Federation. Specifically, the project will strengthen the capacity of the Business Ombudsman institutions and other authorities involved in protecting the rights of entrepreneurs in the Russian Federation from corrupt practices.

The project on “Protection of the Rights of Entrepreneurs in the Russian Federation from Corrupt Practices” is a joint action of the European Union and the Council of Europe. The project is implemented by the Council of Europe and has a foreseen length of 36 months starting from January 2013. The total amount of the budget is 1.3 million EUR jointly contributed by the EU Delegation in the Russian Federation and the Council of Europe.

Following are the expected results:
1) Institutions of regional and public Ombudsmen are informed about the role, objectives and competencies of the Ombudsman for the Protection of Entrepreneurs’ Rights under the President of the Russian Federation and international standards and practices of comparable institutions
2) Overview of good practices in CoE member-states and proposals for protecting whistle-blowers in the area of corruption are available
3) Proposals are available to strengthen measures to prevent the misuse of public authorities corporate in conflicts, eliminating competition and forced takeovers
4) Practice of pro bono legal assistance in the protection of the rights of entrepreneurs is expanded
5) Proposals are available on resolving systemic problems of entrepreneurship for the Experts’ Council under the Ombudsman for the Protection of Entrepreneurs’ Rights under the President of the Russian Federation
6) Awareness of the business community is raised with regard to the risks of infringement of entrepreneurial rights and possible methods for their protection
7) ECtHR-case law relevant to entrepreneurs rights and related corrupt practices is made available and disseminated

Seminar on “Corruption risks, protection mechanisms and good governance for business”
(Kaliningrad, Russian Federation, 15 July 2015)

Over 30 participants including representatives of the Office of the Federal Business Ombudsman, Regional Business Ombudsmen or their staff, law associations and representatives of business associations are expected to participate in the seminar on “Corruption risks, protection mechanisms and good governance for business” which will take place on 15 July in Kaliningrad.
The seminar will provide a venue for the presentation and discussion of two handbooks: “Corruption risks and protection mechanisms for entrepreneurs” and “Good governance in business”, prepared by Council of Europe experts. Further on, participants will develop a set of recommendations for improvement and strengthening of the mechanisms for the protection of entrepreneurs against corruption.


Workshop on “International and Russian practices and principles for pro bono work”
(Kaliningrad, Russian Federation, 14 July 2015)

A workshop on “International and Russian practices and principles for pro bono work”, targeting the Regional Business Ombudsmen and their staff and representatives of legal association, will be held on 14 July 2015 in Kaliningrad, Russian Federation. This activity aims to raise awareness on pro bono services and professional standards in the Russian Federation. During the workshop a special attention will be given to the promotion of Memoranda of Understanding (MoU) for the provision of pro bono services by lawyers and legal associations to Regional Business Ombudsmen in the Russian Federation.


Workshop on “Detention and liability of entrepreneurs for economic crimes and failure to execute contracts”
(Moscow, Russian Federation, 2 July 2015)

A workshop on “Detention and liability of entrepreneurs for economic crimes and failure to execute contracts” will be held on 2 July 2015 at Federal Business Ombudsman Office in Moscow, Russian Federation.
The participants will discuss the findings of the Technical Paper on “Detention and liability of entrepreneurs for economic crimes and failure to execute contracts” prepared by a Council of Europe expert.


Seminar on “Corruption risks, protection mechanisms and good governance for business”
(Arkhangelsk, Russian Federation, 30 June 2015)

Over 30 representatives of the federal business ombudsman office, regional business ombudsmen offices, international organisations and business community are expected to participate in the seminar on “Corruption risks, protection mechanisms and good governance for business” which will take place on 30 June in Arkhangelsk.
The seminar will provide a venue for the presentation and discussion of two handbooks: “Corruption risks and protection mechanisms for entrepreneurs” and “Good governance in business”, prepared by Council of Europe experts. Further on, participants will develop a set of recommendations for improvement and strengthening of the mechanisms for the protection of entrepreneurs against corruption.

(Saint Petersburg, Russian Federation, 20 May 2015)

Over 40 representatives of the offices of regional business ombudsmen, local government agencies and local business associations participated in the seminar on “Corruption Risks and protection mechanisms for entrepreneurs”. The seminar was opened by Alexander Abrosimov, Business Ombudsman of Saint Petersburg and Petr Sich, Head of the Council of Europe Programme Office in Russia. The seminar provided a venue for the presentation and discussion of the handbook on “Corruption risks and protection mechanisms for entrepreneurs” prepared by Council of Europe experts. Among other, the participants discussed issues such as typologies of corruption and corruption risks affecting the business sector; business policies and measures assisting entrepreneurs to minimise the risk of corruption including corruption risks assessment; and good practices of protection mechanisms against corruption introduced by companies.

On the margins of the fifth Seminar on “Corruption Risks and protection mechanisms for entrepreneurs”, a meeting of the Anti-corruption Working Group of Saint Petersburg took place. More than 100 participants contributed to this concrete example of cooperation between public agencies (federal and local) and representatives of the business community. Among the issues discussed were: the fight against corruption/situation in Saint Petersburg in 2014; the interface between the business community and Saint Petersburg public authorities; and the cooperation of the Business Ombudsman Office with law-enforcement authorities and local and federal authorities in Saint Petersburg.


Training on “Good practices on anti-corruption and functioning of Regional Business Ombudsmen’s Offices”
(Saint Petersburg, Russian Federation, 18-19 May 2015)

The sixth and last training for regional business ombudsmen and their staff based on the handbook on “Good practices on anti-corruption and functioning of Regional Business Ombudsman Offices” took place in Saint Petersburg on 18-19 May 2015. It gathered over 40 representatives of the federal business ombudsman office, the regional business ombudsmen offices, and the business community.

The main goal of the training was to ensure a common approach and procedures to the organisation and the functioning of regional ombudsmen offices, to strengthen the understanding of corruption and present international standards to regional participants. During multiple group-work sessions the participants engaged in situational analysis and examination of cases and presented their own recommendations on enhancing the effectiveness of anti-corruption work done in regional business ombudsmen’s offices. The seminar concluded with a discussion on recommendations and potential measures to strengthen the protection mechanisms for entrepreneurs in the Russian Federation.


Training on “Good practices on anti-corruption and functioning of Regional Business Ombudsmen’s Offices”
(Astrakhan, Russian Federation, 22-23 April 2015)

The fifth training for regional business ombudsmen and their staff based on the handbook on “Good practices on anti-corruption and functioning of Regional Business Ombudsman Offices” took place in Astrakhan on 22-23 April 2015.
The main goal of the training was to ensure a common approach and procedures to the organisation and the functioning of regional ombudsmen offices, to strengthen the understanding of corruption and present international standards to regional participants. During multiple group-work sessions the participants engaged in situational analysis and examination of cases and presented their own recommendations on enhancing the effectiveness of anti-corruption work done in regional business ombudsmen’s offices.

The participants in the seminar had an opportunity to discuss on the: typologies of corruption and corruption risks affecting the business sector; business policies and measures assisting entrepreneurs to minimise the risk of corruption including corruption risks assessment; and, good practices of protection mechanisms against corruption introduced by companies in the Russian Federation.


Russian Federal Business Ombudsman visit to the Council of Europe
(Strasbourg, France, 9-10 April 2015)

A delegation headed by the Russian Federal Business Ombudsman, Mr Boris Titov, visited the Council of Europe on 9-10 April 2015.
During the visit, Mr Titov and the members of the delegation met with Secretary General Thorbjørn Jagland as well as other high level representatives of the Council of Europe including Ms Verena Taylor, Director of the Directorate General of Programmes, Mr Christos Giakoumopoulos, Director of the Human Rights Directorate, Mr Ivan Koedjikov, Head of the Action against Crime Department, as well as representatives of GRECO and MONEYVAL.
The main aims of the visit were to take stock on the current cooperation of the Council of Europe with the Ombudsman for the Protection of Entrepreneurs Rights in the Russian Federation through the PRECOP RF project as well as discuss possibilities for potential future cooperation.

4th Steering Committee Meeting
(Moscow, Russian Federation, 3 April 2015)

The 4th Steering Committee meeting of the PRECOP RF project took place on 3 April 2015 at the Federal Business Ombudsman’s Office in Moscow, Russian Federation. The members of the Steering Committee adopted the 2nd Progress Report and discussed the project implementation to date. In addition, they reviewed the workplan and approved the forthcoming activities planned until December 2015.


International Conference on “Impact of Corruption on Business and Investment Climate in the Russian Federation” (Higher School of Economics, Moscow, Russian Federation, 2 April 2015)

In partnership with the High School of Economics (HSE) and the Office of the Federal Business Ombudsman, the PRECOP RF project supported the organization of the international conference on “Impact of corruption on business and investment climate in the Russian Federation”. Council of Europe experts Alina Mungiu-Pippidi and Wim Vandekerckhove presented on “Impact of Corruption on business and investment climate” and the “International Standards for the protection of whistleblowers” to more than 80 participants.
Keynote speakers in the conference included Boris Titov - Business Ombudsman under the President of Russia, Yaroslav Kouzminov - Rector of HSE, Petr Sich - Head of the Council of Europe Programme Office in Russia, Sven-Olov Carlsson - Deputy Head of European Union Delegation to Russia and Vladimir Tarabrin - Ambassador at Large on International Anticorruption Cooperation from the Ministry of Foreign Affairs of Russia.


Seminar on the “Case law of the European Court of Human Rights for the Protection of Entrepreneurs rights”
(Sochi, Russian Federation, 20 March 2015)

The 2nd seminar on the “Case law of the European Court of Human Rights (ECtHR) on the protection of the entrepreneurs’ rights” took place in Sochi on 20 March 2015. Some 50 representatives of the offices of Business Ombudsmen at the Federal and Regional level as well as representatives of government agencies and legal associations from various regions in the Russian Federation attended the seminar. Participants benefited from an overview of the case law on the protection of entrepreneurs’ rights and discussed practical cases dealing with rights of suspects during criminal investigation, protection of property rights and protection of whistleblowers.


Training on “Good practices on anti-corruption and functioning of Regional Business Ombudsmen’s Offices”
(Sochi, Russian Federation, 18-19 March 2015)

The fourth training for regional business ombudsmen and their staff on “Good practices on anti-corruption and functioning of Regional Business Ombudsman Offices” took place in Sochi on 18-19 March 2015. Over 20 participants from various regions were presented with: common approaches and procedures in the organisation and the functioning of the regional ombudsmen offices, an overview of anti-corruption concepts, as well as good practices for professional handling of complaints submitted by entrepreneurs. The training was conducted based on a handbook developed for this purpose within the PRECOP RF project.

Training for regional ombudsmen and their staff on “Basics of the functioning of the business ombudsmen offices and anti-corruption concepts” (Ufa, Russian Federation, 18-19 February 2015)

The third training event for Regional Business Ombudsmen and their staff, based on a handbook developed specifically for this purpose within the PRECOP RF project, took place in Ufa on 18-19 February 2015. The training contributed to better understanding of the national and international anti-corruption standards, which is considered to be an important element for the improved performance of regional business ombudsmen. According to the feedback received, the training provided the much needed practical information that would be implemented by the regional business ombudsmen’s offices in their daily activities.


Seminar on “Corruption risks and protection mechanisms for entrepreneurs”
(Ufa, Russian Federation, 17 February 2015)

Some 50 representatives of institutions from the Russian Federation, including representatives of the Office of the Federal Business Ombudsman, Offices of Regional Business Ombudsmen, local government agencies and business associations participated in the seminar on “Corruption Risks and protection mechanisms for entrepreneurs”, which took place on 17 February 2015 in Ufa.
The seminar was opened by Rafail Gibadullin, Business Ombudsman of the Republic of Bashkortostan and Petr Sich, Head of the Council of Europe Programme Office in Russia. Konstantin Tolkachev, Chairman of the National Assembly – Kurultay of the Republic of Bashkortostan and Marat Magadeev, Deputy Prime Minister of the Government of the Republic of Bashkortostan were among the speakers, along with representatives of the Prosecutor's Office and the Arbitration Court of the Republic of Bashkortostan. Special attention was paid to the effective regional government policy on corruption counteraction and to the anti-corruption measures which are being successfully implemented at the government level in the Republic of Bashkortostan.
A handbook on “Corruption risks and Protection mechanisms for entrepreneurs” prepared by three Council of Europe experts was presented and analysed. Participants engaged in active discussions and presented their own recommendations for further improvement of the protection mechanisms for entrepreneurs in the Russian Federation.


Training on “Good practices on anti-corruption and functioning of Regional Business Ombudsmen’s Offices”
(Kazan, Russian Federation, 29-30 January 2015)

The 2nd training for regional business ombudsmen and their staff based on the training material developed within the PRECOP RF project took place in Kazan on 29-30 January 2015.
The training promoted a common approach and procedures in the organization and the functioning of the regional ombudsmen offices,  strengthening understanding on corruption matters and contributing to the development of measures to counter corruption at the regional level.


Seminar on “Corruption risks and protection mechanisms for entrepreneurs”
(Kazan, Russian Federation, 28 January 2015)

Some 50 representatives of the Federal and Regional Business Ombudsmen offices, as well as local government agencies and local business associations participated in the seminar on “Corruption risks and protection mechanisms for entrepreneurs” which took place on 28 January 2015 in Kazan.
This seminar provided a venue for presenting and discussing the handbook on “Corruption risks and protection mechanisms for entrepreneurs”, prepared by Council of Europe experts. The participants are expected to come up with further recommendations for strengthening the protection mechanisms for entrepreneurs in the Russian Federation.
Furthermore, representatives from the regional government will offered a presentation on effective regional policy in the field of counteracting corruption and on anti-corruption measures implemented by the Republic of Tatarstan.
