Visit of the Government Agent of Ukraine to Poland

The Government Agent of Ukraine before the European Court of Human Rights, the representatives of his Office and the representatives of the Parliament and Secretariat of the Cabinet of Ministers of Ukraine visited Warsaw to familiarise with Polish experience in execution of the European Court of Human Rights (ECtHR) judgments. The event was organized by the Council of Europe project “Support to the implementation of the judicial reform in Ukraine” jointly with the Ministry of Foreign Affairs of the Republic of Poland.

Between 28 and 31 March, the members of the Ukrainian delegation had meetings with the representatives of the Ministry of Foreign Affairs, Ministry of Justice, Ministry of Interior and the Administration of the Republic of Poland, the Senate of the Republic of Poland, the Supreme Court and the Supreme Administrative Court of the Republic of Poland, the National Council of Judiciary, as well as with the Deputy Ombudsman and the National School for the Judiciary and Prosecution. In the course of these meetings each institution shared its practice of execution of the ECtHR judgments and of cooperation with the Government Agent before the ECtHR.

The most important part of the visit was the participation of the Ukrainian delegation in the session of the Inter-ministerial Committee for European Court of Human Rights, established in 2007 by the Government of the Republic of Poland so as to join efforts of all branches of power in the execution process. The above session was chaired by
Ms Justyna Chrzanowska, Government Agent of Poland before the ECtHR, and attended by Ms Renata Szczęch, Undersecretary of State in the Ministry of Foreign Affairs of Republic of Poland. During the session the authorities reported on measures undertaken for the execution of specific judgments of the ECtHR in cases against Poland.

Note: Article 46 of the Convention for the protection of human rights and fundamental freedoms entrusts the supervision over the execution of the ECtHR judgments to the Committee of Ministers of the Council of Europe (CM). In 2011, 924 cases against Poland were pending under the supervision of the CM. By 2016 this number decreased to 223, the supervision in the rest of cases was closed due to the execution by the Polish Government of the relevant ECtHR judgments.
