Member states should ensure that national human rights structures are clearly mandated to address discrimination on grounds of sexual orientation or gender identity.

In particular, they should be able to make recommendations on legislation and policies, raise awareness amongst the general public, as well as – as far as national law so provides – examine individual complaints regarding both the private and public sector and initiate or participate in court proceedings.
