More prevention including civic education and training of EMBs and law enforcement are needed to reduce electoral fraud and increase public trust in electoral processes in Ukraine, concluded participants at the Conference on “Electoral violations and accountability: challenges and possible solutions” which took place in Kyiv on 14 December 2016

The event focused on challenges and constraints of the current system of investigation of electoral offences in Ukraine including roles, competences and responsibilities of regional and local police and prosecutors as well as of civil society organisations. It brought together more than 70 participants representatives of the Parliament, Central Election Commission, Ministry of Interior, Public Prosecutors’ Office, Judiciary and NGOs to discuss a new analysis carried out by OPORA on the efficiency of investigating mechanisms following 2015 local elections in Ukraine.

The analysis shows a growth in the number of electoral violations declared as compared to previous elections due, in particular, to the criminalization of vote buying and other types of electoral violations. However, it points our shortcomings in their efficient investigation with only few cases brought to courts. Lack of adequate, clear and complete legal framework, together with unclear, sometimes overlapping roles of different investigative bodies are among major obstacles for an effective investigation of electoral offences. The analysis generated a roadmap for improving the current system of investigation and reporting which will be endorsed by the Ministry of Interior and the Public Prosecutor’s Office. It also proposes a number of improvements to the criminal and criminal procedure code of Ukraine related to electoral violations.
