The conference “Development of the system of alternative dispute resolution in Ukraine: implementation of mediation” took place in Kyiv on 15 September

The conference on the development of the system of alternative dispute resolutions in Ukraine, namely the implementation of mediation, took place in Kyiv on 15 September 2016 within the Council of Europe project “Support to the implementation of the judicial reform in Ukraine”.

The event was attended by the representatives of the Parliament of Ukraine, the Administration of the President of Ukraine, the Ministry of Justice of Ukraine, the Ministry of Social Affairs of Ukraine, judges and representatives of the Supreme Court of Ukraine and high courts, judges of the local and appellate courts who participated in implementation of the pilot projects in mediation, representatives of the National School of Judges of Ukraine, State Judicial Administration of Ukraine, other Ukrainian authorities, as well as representatives of civil society  and international organisations.

The conference presented the draft policy paper “Implementation of the mediation into the judicial system of Ukraine” made by the national expert of the project, Ms Tatiana Kyselova. In the paper she analysed previous pilot projects as regards the implementation of mediation, identified advantages and disadvantages of an independent and court-bounded models of mediation, and suggested recommendations as to further steps to be undertaken for the implementation of mediation into the judicial system of Ukraine.    

International experts of the Council of Europe, Mr Frans van Arem (judge of the district court of Zwolle-Lelystad, the Netherlands), Ms Wilma van Benthem (judge of the District Court of Amsterdam, the Netherlands), and Mr Ðuro Sessa (judge of the Supreme Court of the Republic of Croatia and Vice-President of the Consultative Council of European Judges), informed the participants on features of an independent and court-bounded mediation, on the role of the judiciary in each of these models, and on the standards and recommendations of the Council of Europe concerning the alternative dispute resolutions.  

In continuation of the conference, the participants agreed on further work for the development of a general strategy for the implementation of the mediation into the Ukrainian judicial system.
