On 26 September, the round table on incorporation of the case-law of the European Court of Human Rights into tasks for qualification assessment of judges took place in Kyiv

On 26 September 2016, a round table on incorporation of the case-law of the European Court of Human Rights into tasks for qualification assessment of judges in Ukraine took place in Kyiv. The event was organized by the Council of Europe project “Support to the implementation of the judicial reform in Ukraine”.

The round table was attended by Mr Borys Gulko, Head of the High Specialized Court of Ukraine for Civil and Criminal Cases, Mr Sergii Koziakov, Head of the High Qualification Commission of Judges of Ukraine, Ms Galyna Kanygina, judge of the Supreme Court of Ukraine, Mr Volodymyr Mazurok, Vice-Rector of the National School of Judges of Ukraine, as well as by judges and representatives of high specialised courts, representatives of the High Qualification Commission of Judges of Ukraine, National School of Judges of Ukraine, Council of Judges of Ukraine, State Judicial Administration of Ukraine, civil society and international organisations, high educational institutions and also by the international expert of the Council of Europe, Mr Ðuro Sessa, who is a judge of the Supreme Court of the Republic of Croatia and the Vice-President of the Consultative Council of European Judges.

During the event the speakers from the High Qualification Commission of Judges of Ukraine and the National School of Judges of Ukraine informed the participants on practice and plans of the authorities they represent about the preparation of tasks for qualification assessment of judges in Ukraine according to the new legislation of Ukraine. Mr Sergii Mudruk, who is the President of the international non-governmental organization “Universal Examinational Network”, spoke about the particularities considering the content in the process of tests development. Mr Mykhailo Tarahkalo, who is the Director of the Center for Strategic Affairs of the Ukrainian Helsinki Human Rights Union, provided his comment as regards the tasks for the qualification assessment of judges as to the provision of the Convention for the Protection of Human Rights and Fundamental Freedoms and the case-law of the European Court of Human Rights. Mr Ðuro Sessa presented the standards of the Council of Europe and the practice of the Republic of Croatia on assessment of judges.

Following the discussion, participants offered recommendations on the incorporation of the case-law of the European Court of Human Rights into the tasks for the qualification assessment of judges in terms of the scope and method so as to ensure the accurate and effective application by judges of the provisions of the Convention for the Protection of Human Rights and Fundamental Freedoms and of the case-law of the European Court of Human Rights.
