Reservations and Declarations for Treaty No.005 - Convention for the Protection of Human Rights and Fundamental Freedoms

Slovak Republic

Declarations contained in a Note verbale from the Federal Ministry of Foreign Affairs of the Czech and Slovak Federal Republic, dated 13 March 1992, deposited with the instrument of ratification of the Convention, on 18 March 1992 – Or. Engl.

The Czech and Slovak Federal Republic declares that for a period of five years, which will be tacitly renewed for further periods of five years, unless the Czech and Slovak Federal Republic withdraws its declaration before the expiration of the appropriate term:

- recognises the competence of the European Commission of Human Rights to receive, in accordance with Article 25 of the Convention, petitions from any person, non-governmental organisation or group of individuals claiming to be the victim of a violation of the rights set forth in the Convention for the Protection of Human Rights and Fundamental Freedoms, in Articles 1 to 4 of Protocol No. 4 and in Articles 1 to 5 of Protocol No. 7, in case the violation of the rights guaranteed in these documents occurred after these documents came into force for the Czech and Slovak Federal Republic,

- recognises, on condition of reciprocity, the jurisdiction of the European Court of Human Rights, in accordance with Article 46 of the Convention for the Protection of Human Rights and Fundamental Freedoms [see Article 34 of the Convention since the entry into force of Protocol No. 11], to interpret and apply the Convention, Articles 1 to 4 of Protocol No. 4 and Articles 1 to 5 of Protocol No. 7, in case the violation of the rights guaranteed in these documents occurred after these documents came into force for the Czech and Slovak Federal Republic.

[Note by the Secretariat: The Committee of Ministers of the Council of Europe, at the 496th meeting of the Ministers' Deputies, on 30 June 1993, decided inter alia that the Czech Republic and the Slovak Republic are to be considered Parties to the Convention for the Protection of Human Rights and Fundamental Freedoms as from 1 January 1993, and that both States are considered bound as from that date by the declarations made by the Czech and Slovak Federal Republic regarding Articles 25 and 46 of the Convention. ]
