Study Visit of Constitutional Court of Turkey to the Council of Europe

 

The second study visit of the Constitutional Court of Turkey (TCC) to the Council of Europe took place on 19-20 October 2016 in Strasbourg, France. The visit aimed to provide participants with a closer insight into the work of the Council of Europe (the Council) and the European Court of Human Rights (ECtHR). It is expected to contribute to improving the co-operation between the TCC and the ECtHR, and eventually to increase the capacity of the TCC and effectiveness of the individual application system.

The delegation consisted of the deputy Secretary General, Chief Rapporteurs, rapporteurs and assistant rapporteurs from the TCC, who had meetings with the senior lawyers from the Turkish divisions of the ECtHR and other experts from various departments of the Council where they discussed the recent case-law of the ECtHR, execution of the judgments, as well as the challenges of the implementation of the ECHR and ECtHR case law at the national level.

Mr Muharrem İlhan Koç, Chief Rapporteur of the TCC, made a presentation informing the lawyers from the ECtHR and the CoE on the challenges of the individual application process following the coup attempt in Turkey. The staff members of the CoE and ECtHR showed interest in the presentation and asked several questions on the situation and plans of the TCC to handle the flood of applications after the Decrees of the Government and the state of emergency in Turkey.

Other sessions included presentations on the work and policies of the Council, including the execution of ECtHR’s judgments, Venice Commission, Media and Internet Division, and European Committee for the Prevention of Torture.

The Delegation attended a Grand Chamber hearing (Regner v. Czech Republic) during the study visit.
