Study Visit of a Delegation of Turkish Judges and Prosecutors to the Council of Europe and the European Court of Human Rights

 

The sixth study visit under the Joint Project on “Supporting Individual Application to the Constitutional Court in Turkey” was organized to the Council of Europe and the European Court of Human Rights on 14 – 16 June 2017. A delegation of 25 participants consisting of Turkish civil and criminal judges and public prosecutors participated in the study visit.

During the study visit, the delegation had meetings with the senior lawyers from the Turkish divisions of the ECtHR where they discussed key concepts, main principles and the recent case laws of the ECtHR on various articles of the European Convention on Human Rights (ECHR) including new challenges, procedure, and overview of Article 15 (Derogation in time of emergency), the principle of subsidiarity, negative and positive obligations of the State and the notion of effective investigation under Articles 2 (Right to life), 3 (Prohibition of torture) and 8 (Right to respect for private and family life), freedom of thought, conscience and religion, freedom of expression and freedom of assembly and association, protection of property, the right to liberty and security and the right to a fair trial.

The delegation was also briefed on the policies and practices of the Council of Europe by experts from various departments of the Council such as the Execution of Judgments, the European Commission for Democracy through Law (Venice Commission), European Social Charter and the Human Rights Education for Legal Professionals (HELP) Programme and Tools.

The delegation also attended the Grand Chamber hearing of case no. 51357/07 Naït-Liman v. Switzerland.
