Study visit of Turkish lawyers to the Council of Europe and the European Court of Human Rights

 

The ninth study visit under the Joint Project on “Supporting the Individual Application to the Constitutional Court in Turkey” was organized to the Council of Europe and the European Court of Human Rights on 4-6 June 2018. A delegation consisting of 22 trainer-lawyers of the project and a representative of the Union of Turkish Bar Associations participated in the study visit.

During the study visit, the delegation had meetings with the senior lawyers from the Turkish divisions of the ECtHR where they discussed procedures, new challenges and recent developments concerning the ECtHR, how to fill in an application form for the ECtHR and the recent case laws of the ECtHR on various articles of the European Convention on Human Rights (ECHR) including the principle of subsidiarity, negative and positive obligations of the State under Article 5 (right to person’s liberty and security), Article 2 (the right to life), Article 3 (prohibition of torture) and Article 8 (the right to respect for private life and family life), the right to fair trial in civil and criminal proceedings and the protection of property.

The delegation also met with experts from various departments of the Council of Europe and was briefed on the Human Rights Commissioner, the European Commission for Democracy through Law (Venice Commission), European Social Charter and the Human Rights Education for Legal Professionals (HELP) Programme.

The delegation also attended the Grand Chamber hearing of case no. 18052/11 Rooman v. Belgium.
