Overall objective

 

This Action aims to improve the day-to-day functioning and quality of the justice system in Kosovo*, by making available to the beneficiaries the methodology and tools of the CEPEJ. The application of this methodology and tools leads to an increased capacity of the responsible beneficiaries to assess the efficiency of the Kosovo* judicial system, ensuring that justice is delivered within a reasonable time and that it meets good quality standards.

This Action will address the courts, and also strengthen the knowledge of the beneficiaries on the tools and methodology of the CEPEJ.

 

Specific objectives

 

The first specific objective is to enhance the efficiency of the justice system in accordance with CEPEJ standards and tools on judicial statistics and time management with:
- An in-depth and global assessment of the judicial system with recommendations for improvements;

- Support to the capacity of the KJC and of courts to improve judicial time management, the collection and management of statistical data and enhance their efficiency in accordance with CEPEJ methodology and tools, in particular the SATURN Guidelines.


The second specific objective is to enhance the quality of the justice system, in accordance with CEPEJ quality standards and tools with:

- Court Coaching Programmes in close cooperation with the KJC in individual courts in view of building the capacity of courts to deliver a better justice service in accordance with CEPEJ quality tools such as the Checklist for promoting the quality of justice and the courts and the Handbook on conducting users’ satisfaction surveys.

News

 

14-17 March 2017: Court Coaching activities in Kosovo*

Under the new Action "Strengthening the efficiency and quality of justice in Kosovo*" (KoSEJ), which is part of the programme entitled "Horizontal Facility for the Western Balkans and Turkey", co-funded by the European Union and the Council of Europe and implemented by the Council of Europe, a team of CEPEJ international experts visited the Court of Appeals as well as the Basic Courts of Ferizaj and Gjilan to collect information concerning the functioning of these courts, in particular existing challenges in daily activities. This information will be analysed progressively in individual court coaching reports which will include recommendations on areas for improvement in accordance with CEPEJ tools and methodology. CEPEJ experts also met with the newly-appointed President of the Basic Court of Pristina to raise awareness on CEPEJ tools to improve the efficiency of its daily work and to follow-up on the implementation of a court-coaching project within the civil department of the court to address its backlog. The first phase of the project will aim at collecting detailed information about the composition of the judges’ caseload and the age of pending civil cases and shall be implemented in the coming months.

 

Presenting the SATURN Time Management Guidelines for Court Managers and the CEPEJ indicators of court performance to the newly-appointed Presidents of Courts in Kosovo*

The KoSEJ Action “Strengthening the Quality and Efficiency of Justice in Kosovo”, which is part of the programme entitled "Horizontal Facility for the Western Balkans and Turkey", co-funded by the European Union and the Council of Europe and implemented by the Council of Europe, organized a workshop on “Court Management” on Friday 10 March 2017 in cooperation with the newly-established Kosovo Justice Academy. This institution recently took over the responsibilities of the previous Kosovo Judicial Institute in providing initial and continuous legal education for judges, prosecutors and other legal professionals in Kosovo. During the workshop, a CEPEJ expert presented the SATURN Time Management Guidelines for Court Managers as well as the CEPEJ indicators of court performance to the Presidents of the Courts who have been appointed in January 2017 for a 4-year mandate. The objective of the workshop was to promote the use of the mentioned CEPEJ tools when managing courts and improve the efficiency of justice in Kosovo.

 

Implementing CEPEJ tools to support the development of the case management information system (CMIS) in Kosovo*

Under the KoSEJ Action "Strengthening the efficiency and quality of justice in Kosovo*", which is part of the programme entitled "Horizontal Facility for the Western Balkans and Turkey", co-funded by the European Union and the Council of Europe and implemented by the Council of Europe, representatives of the CEPEJ went to Pristina on 21 and 22 February 2017 to support the development of the case management information system (CMIS) with targeted expertise to ensure that it will serve the efficiency and quality of justice in Kosovo.The contribution of the CEPEJ aims at improving, in the long term, the collection and analysis of judicial statistics in Kosovo, in accordance with the CEPEJ methodology. On this occasion, a CEPEJ expert and a member of the CEPEJ Secretariat will meet with the CMIS team as well as other relevant interlocutors representing the Action’s beneficiaries, within the Kosovo Judicial Council and the courts, to present the Cyberjustice Guidelines adopted by the CEPEJ in December 2016 as well as the Checklist contained therein for organizations responsible for developing and managing IT projects. The aim of the mission is also to ensure that the new system will produce statistical dashboards in line with CEPEJ indicators.

- 1st meeting of the Steering Committee, 6 February 2017
The first meeting of the Steering Committee (SC) of the KoSEJ Action took place on 6 February 2017 at the Council of Europe Office in Pristina. The Steering Committee has been hosted by the Council of Europe and the European Union and participants included representatives of all beneficiaries as well as partners. The aim of this first meeting was firstly to adopt the terms of reference of the Steering Committee, and highlight the importance of its steering role to ensure the relevance and efficiency of the Action with respect to its specific objectives. This was the first opportunity to discuss progress made and envisage future activities to ensure the success of the KoSEJ Action.
- CEPEJ Roadshow in Kosovo* to raise the awareness of beneficiaries on CEPEJ tools, 7 February 2017
A high-level conference will be organised on 7 February 2017 in Pristina. In the presence of the Minister of Justice, the Head of the Kosovo Judicial Council, the Head of the European Union Office and main actors of the justice system, eminent CEPEJ international experts will present and discuss with them the work of the CEPEJ and its concrete tools to improve the efficiency and quality of justice. Empowering all beneficiaries and partners in using CEPEJ tools and methodology is essential to ensuring successful results.
Programme

- Meeting with the Kosovo Judicial Council to address the quality of justice in Kosovo*, 8 February 2017
To address one of the specific objectives of the KoSEJ Action to improve the quality of justice, the Chairman of the CEPEJ Working Group on Quality of Justice (GT-QUAL), Mr François PAYCHERE, will meet with the Head of the Kosovo Judicial Council Secretariat to discuss challenges in accessing justice in Kosovo* in light of the recently-adopted CEPEJ Guide "Measuring the Quality of Justice" as well as the CEPEJ "Checklist for Promoting the Quality of Justice". This meeting will be a first step in the identification and implementation of potential solutions which could be sought in the framework of the KoSEJ Action in cooperation of the KJC and in accordance with CEPEJ tools and methodology.

In-depth assessment of the judicial system in Kosovo*

Under the Action "Strengthening the efficiency and quality of justice in Kosovo*" (KoSEJ), which is part of the programme entitled "Horizontal Facility for the Western Balkans and Turkey", co-funded by the European Union and the Council of Europe and implemented by the Council of Europe, two CEPEJ experts conducted a mission in Kosovo from 12 to 14 December 2016. The objective of this mission was to collect data on the basis of the CEPEJ Evaluation Scheme and obtain additional information, in particular on the general functioning of the judicial system, as well as the daily work of courts and prosecution services.

 

Evaluation mission on judicial statistics and on information technologies in the judicial field in Kosovo*

Under the Action "Strengthening the efficiency and quality of justice in Kosovo*" (KoSEJ), which is part of the programme entitled "Horizontal Facility for the Western Balkans and Turkey", co-funded by the European Union and the Council of Europe and implemented by the Council of Europe, the CEPEJ Secretariat went to Kosovo* from 22 to 24 November 2016 to pre-assess the quality and the methodology to collect judicial statistics, as well as to meet with partners of the CMIS project to collaborate on the computerisation of courts. On this occasion, the meetings with key interlocutors representing the Action’s beneficiaries, partners and other relevant actors is an important step to prepare an expert’s mission in December 2016 which will serve the first draft of the in-depth assessment of the justice system in Kosovo*. 

 

Inception mission in the framework of the Project "Horizontal facility for Western Balkans and Turkey in Kosovo* on 6 and 7 September 2016

A team from the CEPEJ Secretariat will visit Kosovo * (Pristina) to launch the new project entitled "Strengthening the effectiveness and quality of justice in Kosovo *", which is part of the programme entitled "Horizontal Facility for the Western Balkans and Turkey", funded by the European Union and implemented by the Council of Europe. The team will meet the key project partners (Minister of Justice, Council of Justice, Court Presidents), as well as with international actors, to discuss the activities that will be implemented as part of this new project.
